South Mountain Commons Project, Wal-Mart
(240+ acres) calls for a Wal-Mart Super Store measuring 203,819sf, This supercenter development includes a tire & lube
facility, gas station,and sites for four 7,000sf. high turnover sit-down Restaurants.  another 6,000sf Shopping Center and a
3 lane drive-in Bank.
Also include 175 Townhouses and another 15,000sf Shopping Center, Lowes and YMCA
plans also include a new arm of Route 74 to be 7 LANES WIDE at a new intersection
with Route 15 about a half-mile north of the current intersection.

For local communities one of the most salient issues surrounding a proposed Wal-Mart is traffic.
These people may have no ideological problem with the retailer but they become quite distressed
when their already congested local roads are asked to accommodate the influx engendered by
200,000+ sq. ft. Supercenters. -

April 2, 2007 the Board of Supervisors conditionally approve the South Mountain Commons
(Wal*Mart) project. 18 comments and 14 waivers were approved
(2 Supervisors voted against, 3 for approval)

May 2, 2007 CCSG appeals the Carroll Township Board of Supervisors decision
The Supervisors' decision should be reversed because the preliminary subdivision plans do
not comply with the requirements set forth in the Township's subdivision and land
development ordinance furthermore, the Supervisors abused their discretion and
committed an error of law by granting the Developer numerous waivers.

September 10, 2008  CCSG wins its appeal
Judge Linebaugh remanded the decision because the preliminary subdivision plans did not
comply with the requirements set forth in the Township's Subdivision and Land
Development and the Zoning Ordinances; furthermore,

The Supervisors abused their discretion and committed an error of law by granting
approval.
