April 2, 2007 the Board of Supervisors conditionally approve the South Mountain Commons (Wal*Mart) project. 18 comments and 14 waivers were approved (2 Supervisors voted against, 3 for approval) May 2, 2007 CCSG appeals the Carroll Township Board of Supervisors decision The Supervisors' decision should be reversed because the preliminary subdivision plans do not comply with the requirements set forth in the Township's subdivision and land development ordinance furthermore, the Supervisors abused their discretion and committed an error of law by granting the Developer numerous waivers. September 10, 2008 CCSG wins its appeal Judge Linebaugh remanded the decision because the preliminary subdivision plans did not comply with the requirements set forth in the Township's Subdivision and Land Development and the Zoning Ordinances; furthermore, The Supervisors abused their discretion and committed an error of law by granting approval.
